Not a Sioux said...: The "riparian rights" issue might come into play here. In Minnesota (as is typical here and in the east), "Riparian rights are property rights arising from owning shoreland....The riparian owner has the right to make use of the lake over its entire surface".

What usually means is that anyone with land on the shore of a navigable lake (including the State government) can go all over the lake.

This is probably a major element of the dispute, even though the word "riparian" does not appear in the article. Such disputes can be thorny legal matters, even when tribal soveriegnty is not thrown into the mix.; 7:10 AM
